Dragon Apps

Effective Date: January 2, 2025

Important: Please read these Terms of Service carefully before using any Dragon Apps. By downloading, installing, or using our Apps, you agree to be bound by these Terms.

1. Introduction & Acceptance

Welcome to Dragon Apps! These Terms of Service ("Terms") govern your use of mobile applications developed and published by James Maine, including but not limited to:

Dragon Media Manager Dragon SSH Future Dragon Apps

By accessing or using any of our Apps (collectively, "the Apps"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Apps.

2. Definitions

  • "Apps" refers to all mobile applications developed by James Maine under the Dragon Apps brand
  • "User" or "you" refers to any person who downloads, installs, or uses the Apps
  • "Services" refers to the functionality and features provided by the Apps
  • "Content" refers to any data, information, or materials accessed, managed, or transmitted through the Apps
  • "Third-Party Services" refers to external services, APIs, or servers that the Apps may integrate with or connect to

3. Eligibility

You must be at least 13 years of age to use the Apps. If you are under 18, you must have permission from a parent or legal guardian to use the Apps. By using the Apps, you represent and warrant that you meet these age requirements.

If you are a parent or guardian, you are responsible for monitoring and controlling your minor's use of the Apps, particularly for Apps that provide server access capabilities.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Apps on compatible devices that you own or control, solely for your personal, non-commercial purposes.

This license does NOT include the right to:

  • Modify, adapt, translate, or create derivative works of the Apps
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code
  • Rent, lease, sell, sublicense, distribute, or otherwise transfer the Apps
  • Remove, alter, or obscure any proprietary notices from the Apps
  • Use the Apps in any manner that violates applicable laws or regulations

5. User Responsibilities

You are responsible for:

  • Maintaining the security and confidentiality of your device and any credentials used with the Apps
  • All activities that occur through your use of the Apps
  • Ensuring you have proper authorization to access any servers, systems, or services you connect to through the Apps
  • Backing up any important data before using Apps that interact with servers or systems
  • Understanding the commands and actions you perform using the Apps
  • Compliance with all applicable laws and regulations in your jurisdiction
  • Any costs associated with using third-party services integrated with the Apps

6. Data Collection and Third-Party Services

Local Data Processing

Most Apps store configuration data, connection details, and preferences locally on your device. We do not collect or have access to this information stored on your device.

AI Services

Some Apps integrate with third-party AI services (such as Google Gemini API) to provide intelligent assistance features. When you use these features, certain data may be transmitted to these services, including:

  • Your natural language requests and questions
  • Server operating system and configuration information
  • Recent command output (for context)
  • Conversation history within the session

Your SSH credentials (passwords and private keys) are NEVER sent to AI services. However, you should avoid including sensitive information in your requests to AI features.

Other Third-Party Services

Our Apps may integrate with various third-party services including but not limited to:

  • Google Gemini API - For AI-powered features
  • Apple Intelligence - For on-device AI features (where available)
  • TMDB - For media information and artwork
  • Radarr, Sonarr, SabNZB - Open-source media management software you host

These services are subject to their own terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

7. Acceptable Use

You agree NOT to use the Apps to:

  • Violate any applicable laws or regulations
  • Access servers, systems, or networks without authorization
  • Infringe on intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Engage in any illegal hacking or unauthorized access activities
  • Share credentials or authentication tokens publicly
  • Attempt to reverse engineer, modify, or create derivative works of the Apps
  • Use the Apps in any manner that could damage, disable, or impair our services
  • Circumvent any security features or access controls

8. Remote Server Access

For Apps that provide remote server access (such as Dragon SSH):

  • You acknowledge that commands executed on remote servers can have serious and potentially irreversible consequences
  • AI-generated command suggestions are provided as assistance only; you are responsible for reviewing and understanding any command before execution
  • We are not liable for any damage, data loss, or other consequences resulting from commands you execute
  • You should always maintain proper backups of critical systems and data
  • You acknowledge that SSH connections involve transmitting data over networks you may not control

9. Intellectual Property

The Apps, including their design, code, graphics, user interface, and branding, are the property of James Maine. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal purposes in accordance with these Terms.

You may not:

  • Copy, modify, or distribute the Apps
  • Reverse engineer or decompile the Apps
  • Remove any copyright or proprietary notices
  • Use our trademarks without written permission

Your use of the Apps is also governed by our Privacy Policy, available at privacy.myandroidremote.org. By using the Apps, you consent to our collection and use of information as described in the Privacy Policy.

You agree to indemnify, defend, and hold harmless James Maine and any affiliated parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Apps
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations
  • Any content or data you access, manage, or transfer using the Apps

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Effective Date" at the top of these Terms. Your continued use of the Apps after any changes constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically for any updates.

15. Termination

We may terminate or suspend your access to the Apps at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your license to use the Apps will immediately cease
  • You must delete all copies of the Apps from your devices
  • Provisions that by their nature should survive termination will remain in effect

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Apps shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and James Maine regarding the use of the Apps and supersede any prior agreements.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by James Maine.

20. Apple App Store Terms

If you downloaded an App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and James Maine, not Apple
  • Apple has no obligation to provide maintenance or support for the Apps
  • Apple is not responsible for addressing any claims relating to the Apps
  • Apple is a third-party beneficiary of these Terms
